These Terms and Conditions govern access to and use of the online store available at https://cortartec.eu/ , as well as the conditions applicable to the purchase of products sold through it.

CORTARTEC may henceforth be referred to as “Cortartec”, “we”, “our” or “seller”. The user, customer or buyer may be referred to as “Customer”.
Use of this website and placing orders implies reading, understanding, and accepting these Terms and Conditions.
1. Scope of the online store
Cortartec's online store is dedicated to the sale of materials, systems and technical products for engineering, architecture and civil construction, including, among others, fire-resistant products, expansion joints, finishing profiles, transition profiles, wall protection solutions, skirting boards, products for masonry rehabilitation and other technical materials.
The store can be used by professional clients and end consumers. Some conditions may vary depending on whether the Client acts as a consumer, i.e., an individual purchasing for non-professional purposes, or as a professional client, i.e., a company, public entity, contractor, installer, designer, or other operator purchasing for purposes related to their activity.
Whenever the law grants mandatory rights to consumers, those rights prevail over any provision of these Terms and Conditions.
2. Product technical information
The products marketed by Cortartec are technical construction materials, and their correct selection, application, and performance may depend on several factors, including the type of work, support, substrate, construction system, environmental conditions, regulatory requirements, specialty design, fire resistance class, structural movement, joint width, compatibility with other materials, and installation method.
The information provided on the website, namely descriptions, images, technical data sheets, certificates, reports, dimensions, colors, classifications, drawings, and application recommendations, is provided to assist the Customer in choosing the product. However, it does not replace technical validation by a designer, site manager, qualified installer, or competent entity.
For products subject to certification, fire resistance classification, declaration of performance, CE marking, testing or approval, the indicated performance is only applicable when the product is installed under the conditions specified in the respective technical documentation, application instructions, test reports or classified systems.
The Customer is responsible for confirming, before purchase, whether the product is suitable for its intended purpose, meets project requirements, complies with applicable legislation, and is suitable for actual application conditions.
3. Images, colors, designs and tolerances
The product images shown on the website are for illustrative purposes only and may not exactly match the final appearance of the delivered product, particularly regarding color, brightness, texture, finish, scale, included accessories, or final configuration.
The dimensions, weights, lengths, widths, and thicknesses indicated may be subject to normal manufacturing, cutting, packaging, or production tolerances, unless expressly stated otherwise.
If you have any questions about measurements, compatibility, accessories, or application conditions, the Customer should contact Cortartec before completing the order.
4. Prices
The prices shown in the online store are in euros.
Unless expressly stated otherwise, the prices shown include VAT at the current legal rate. If any price is shown excluding VAT, this information will be clearly indicated before the purchase is completed.
Prices do not include shipping costs, special transport, unloading, lifting equipment, additional insurance, customs fees, administrative expenses, or other associated costs, except when expressly indicated on the website or at checkout.
Cortartec reserves the right to change prices, campaigns, discounts, shipping costs, or commercial terms at any time. Changes do not affect orders already confirmed, except in cases of obvious error.
5. Errors in pricing, inventory, or information.
Despite efforts to keep information up-to-date, errors may occur regarding price, stock, description, photograph, technical specifications, reference, availability, or product characteristics.
If a significant error is detected in an order already placed, Cortartec will inform the Customer as quickly as possible and may propose correcting the order, replacing it with an equivalent product, canceling the order, or refunding the amounts paid.
Cortartec is not obligated to supply products with manifestly incorrect prices or information when the error is evident and recognizable by the Customer.
6. Orders
To place an order, the Customer must select the desired products, add the items to the cart, fill in the requested information, choose the payment method, and confirm the purchase.
Before confirming the order, the Customer must carefully verify the products, quantities, dimensions, references, delivery address, billing information, telephone contact and other relevant information.
Automatic order confirmation does not imply final acceptance when it is dependent on stock validation, technical confirmation, special transport calculation, payment approval, or supplier availability confirmation.
Cortartec may refuse or cancel orders in case of product unavailability, obvious error, suspected fraud, breach of commercial conditions, impossibility of delivery, lack of payment, or incorrect data provided by the Customer.
7. Products available upon request, customized or made to order.
Some products may be marked as "on request", "by quotation", "price on request", "out of stock", "to be confirmed" or with an indicative price.
Products cut to size, manufactured to order, configured according to customer specifications, personalized, adapted to a specific project, or imported specifically for an order are subject to prior confirmation of price, delivery time, payment terms, and the possibility of cancellation.
After order confirmation and commencement of manufacturing, cutting, preparation, import, or customization, these products cannot be canceled or returned, except in the case of defect, non-conformity, or other legally applicable right.
8. Payments
The online store may offer different payment methods, including bank card, Multibanco reference, MB Way, bank transfer, PayPal, or other methods indicated at checkout.
The order will only be processed after successful payment, unless otherwise agreed in writing.
In the case of payment by bank transfer, the Customer must indicate the order reference in the transfer description and send proof of payment whenever requested.
Cortartec is not responsible for delays in order processing resulting from unidentified payments, incomplete payments, or pending bank validations.
9. Revenue
The invoice will be issued based on the information provided by the Customer at the time of purchase.
The Customer is responsible for ensuring that their name, tax ID/company tax number, address, and other billing information are correct before completing the order.
After the invoice has been issued, changes to the tax information may not be possible or may depend on applicable tax rules.
10. Deliveries and transport
Deliveries will be made to the address provided by the Customer at the time of ordering.
Shipping costs are calculated at checkout or communicated later when dealing with bulky, heavy, long, fragile, palletized products or those requiring special transport.
The indication of "free shipping" only applies to the conditions expressly stated on the website and may exclude heavy, bulky products, products with special lengths, deliveries outside mainland Portugal, deliveries to construction sites, urgent deliveries, dedicated transport, or orders subject to consultation.
The delivery times shown are estimates and may vary depending on stock, manufacturer availability, production, transport, holidays, industrial vacation periods, strikes, weather conditions, customs formalities or other external factors.
Cortartec is not responsible for delays attributable to the carrier, the Customer, third parties, or force majeure events.
11. Receiving the goods
Upon delivery, the Customer must check the external condition of the packaging, pallet, or product.
If there is visible damage, missing items, a damaged package, a broken or deformed product, or signs of mishandling, the Customer must mention the issue on the shipping document and, whenever possible, photograph the package before opening it.
It is recommended that any transport damage be reported to Cortartec within a maximum of 24 hours after delivery, accompanied by photographs of the packaging, shipping label, delivery note and damaged product.
Signing a transport document without reservation may make it difficult to file a claim with the carrier.
12. Installation and application of the products
The installation of the products must be carried out by qualified professionals and in accordance with the technical data sheets, application instructions, applicable standards, good construction practices, design and current regulations.
Cortartec is not responsible for damages, performance failures, loss of certification, non-conformities or losses resulting from incorrect installation, improper use, improper storage, product alteration, application to unsuitable media, combination with incompatible materials or disregard for technical instructions.
In fire-resistant products, the Customer must ensure that the chosen solution corresponds to the required construction element, opening, penetration, support, thickness, classification, and applicable report. The advertised fire resistance or performance always depends on the application as per the tested or classified system.
13. Right of withdrawal for consumers
When the Customer is a consumer, they may exercise the right of withdrawal within 14 days from the day on which the consumer, or a third party indicated by them other than the carrier, acquires physical possession of the goods.
To exercise this right, the consumer must communicate their decision to cancel the contract through an unequivocal statement sent to:

The consumer may use the following model:
"I hereby inform you that I am terminating my purchase and sale agreement relating to the following product: [identify product], ordered on [date] and received on [date]. Consumer name: [name]. Address: [address]. Date: [date]."
After communicating the decision to cancel, the consumer must return the goods without undue delay and within a maximum period of 14 days from the date on which the cancellation was communicated.
The product must be returned in good condition, complete, without signs of misuse, with accessories, manuals and original packaging whenever possible.
The consumer may be held liable for the depreciation of the goods if the handling performed exceeds what is necessary to ascertain their nature, characteristics, and functioning.
14. Exceptions to the right of withdrawal
The right of withdrawal does not apply, unless otherwise agreed, in particular to the following cases:
a) Products manufactured, cut, adapted or customized according to Customer specifications;
b) Products imported or specifically ordered for the Customer, when configured according to a specific request;
c) Products that, after delivery and by their nature, become inseparably mixed or incorporated into a work, installation, mortar, glue, sealant, paint, coating or other material;
d) Products that cannot be returned due to reasons related to their nature, deterioration, expiration date, safety, hygiene, or preservation, where applicable;
(e) Services fully rendered with the consumer's prior consent, when the consumer acknowledges that they lose the right to freely terminate the contract after the service has been fully performed.
These exceptions do not prejudice the consumer's rights in case of defects or non-conformity.
15. Refunds
In the event that a consumer exercises their right of withdrawal, Cortartec will reimburse any payments received, including any standard delivery costs initially paid, where applicable.
The refund will be processed using the same payment method used for the purchase, unless otherwise agreed.
Cortartec may withhold the refund until it receives the returned goods or until the consumer provides proof of shipment of the goods, whichever occurs first.
The direct costs of the return are borne by the consumer, unless Cortartec agrees to bear them or the law provides otherwise.
No additional costs will be reimbursed if the Customer chooses a more expensive delivery method than the standard delivery method offered by Cortartec.
16. Returns from professional clients
Purchases made by professional clients, companies, contractors, installers, resellers, public entities, or other economic operators do not benefit from the legal right of free resolution provided for consumers.
Acceptance of returns from professional clients is contingent upon prior written authorization from Cortartec.
When accepted, the return may be subject to verification of the product's condition, original packaging, lack of use, return deadline, shipping costs, administrative costs, depreciation, or restocking fee.
Returns will not be accepted for products that have been cut, custom-made, personalized, imported specifically for the order, damaged, incomplete, used, installed, or without proper packaging.
17. Legal guarantee and compliance
Cortartec is responsible to consumers for any non-conformity of goods under applicable law.
In the case of movable goods sold to consumers, the legal liability period for non-conformity is 3 years from the delivery of the goods, without prejudice to the specific rules applicable to used goods, goods with digital elements or other legally foreseen situations.
In the event of non-conformity, the consumer may be entitled to restoration of conformity through repair or replacement, a proportional price reduction, or termination of the contract, in accordance with the law.
The legal warranty does not cover damage resulting from misuse, normal wear and tear, incorrect installation, inadequate maintenance, improper storage, product alteration, application under unforeseen conditions, failure to comply with technical instructions, use of incompatible accessories, or intervention by third parties.
For products sold to professional clients, the applicable legal, commercial, or manufacturer's warranties apply, as well as the contractual rules agreed upon between the parties.
18. Complaints regarding defects or non-conformity
Any complaint regarding defects, damage, or non-conformity must be communicated to Cortartec by email, including order identification, invoice, product, description of the problem, and photographs or documents that allow for an assessment of the situation.
Cortartec may request the return of the product, a technical inspection, the sending of samples, an analysis of the application site, or other elements necessary to determine the cause of the complaint.
When a complaint is accepted, Cortartec will proceed in accordance with applicable law, and may repair, replace, reimburse, or propose another appropriate solution.
The application, cutting, installation, or incorporation into a project of a visibly damaged, incorrect, or non-compliant product without prior notification may limit the possibility of replacement or claim, except for mandatory consumer rights.
19. Reservation of ownership
The supplied products remain the property of Cortartec until full payment of the respective price, including VAT, shipping, charges and other amounts due.
Until full payment is received, the Customer shall not sell, transform, apply, transfer, encumber, or dispose of the products in a way that prejudices Cortartec's rights, unless otherwise agreed in writing.
20. Technical support
Cortartec may provide technical support, recommendations, clarifications, or product suggestions based on the information provided by the Customer.
This support does not replace design, calculations, technical direction, supervision, installer responsibility, validation by a competent authority, or compliance with applicable legislation.
The Client must provide complete and accurate information regarding the work, support, dimensions, intended use, technical requirements, application environment, and other relevant conditions.
Cortartec is not responsible for recommendations based on incomplete, incorrect, or insufficient information provided by the Client.
21. Responsibility
Cortartec will not be liable for indirect damages, lost profits, production losses, work delays, contractual penalties, labor costs, removal, reinstallation, work stoppage, or other consequential damages, except where such liability results from mandatory legal provisions.
Nothing in these Terms and Conditions excludes or limits Cortartec's liability where such exclusion or limitation is prohibited by law, particularly in matters of consumer rights, willful misconduct, gross negligence, or mandatory legal liability.
22. Force majeure
Cortartec will not be liable for delays, defaults, or inability to supply resulting from events beyond its reasonable control, including, but not limited to, strikes, labor disputes, transportation failures, stock shortages, lack of raw materials, fires, floods, inclement weather, accidents, pandemics, wars, riots, acts of public authorities, legal changes, customs blockades, supplier failures, temporary factory closures, or force majeure events.
In such cases, Cortartec will inform the Customer as soon as possible and will seek to present a suitable solution, namely a new delivery date, an alternative product or cancellation of the order with a refund of the amounts paid, when applicable.
23. Intellectual property
All content on this website, including text, images, photographs, drawings, logos, trademarks, catalogs, technical specifications, videos, graphics, layouts, and other elements, are the property of Cortartec or used with the permission of their respective owners.
Copying, reproduction, distribution, alteration, publication, transmission, or commercial use of any content from this website is prohibited without prior written authorization from Cortartec, except in cases legally permitted.
24. Protection of personal data
Personal data collected through the online store is processed in accordance with the Privacy Policy available on the website.
The data may be used for order processing, billing, delivery, customer support, compliance with legal obligations, fraud prevention, and commercial communications when legally permitted or consented to by the Customer.

26. Complaints Book
Cortartec provides access to the Electronic Complaints Book through the respective link on the website.
The customer may file a complaint through the official Electronic Complaints Book platform or request clarifications directly from Cortartec through the indicated contacts.
27. Alternative dispute resolution for consumer disputes
In the event of a consumer dispute, the consumer may resort to an Alternative Dispute Resolution entity.

Consumers can also consult the updated list of alternative dispute resolution entities for consumer disputes provided by the Directorate-General for Consumer Affairs.
The European online dispute resolution platform was discontinued on July 20, 2025, so consumers should resort to the national alternative dispute resolution methods currently available.
28. Changes to the Terms and Conditions
Cortartec may change these Terms and Conditions at any time, in particular to adapt to legal, operational, commercial or technical changes.
The version applicable to each order will be the one in effect at the time of purchase confirmation, unless otherwise stipulated by law.
29. Applicable law and competent jurisdiction
These Terms and Conditions are governed by Portuguese law.
In the event of a dispute with professional clients, the Portuguese court with territorial jurisdiction over the headquarters of Cortartec shall have jurisdiction, unless otherwise agreed in writing or required by mandatory law.
In the case of consumers, the legally competent court applies, without prejudice to the right to resort to alternative dispute resolution entities for consumer disputes.
